5th International Conference on the Law of the Sea

Regional Cooperation and Marine Environmental Protection under the UNCLOS Regime

The Ministry of Foreign Affairs will be holding the Fifth International Conference on the Law of the Sea from December 3 to 4. The International Conference on the Law of the Sea has been held since 2016 to discuss the latest trends and progress in the research on the United Nations Convention on the Law of the Sea (UNCLOS), which regulates the peaceful usage of the sea and fair and effective utilization of its resources, and on the jurisprudence of relevant international organizations.

The pollution of the marine environment caused by marine litters, microbeads, radioactive water releases, and other sources has become a serious problem. To address marine pollution, we need to employ a global-scale approach and carry out practical actions and measures that take into account the distinct characteristics of each region. Part XII of UNCLOS, often referred to as the Ocean Charter, requires member states to establish and implement innovative and comprehensive legal mechanisms to protect and preserve the marine environment. Section 2 of Part XII, in particular, stipulates that all member states need to cooperate on a regional basis for the protection and preservation of the marine environment. It also obliges member states to notify imminent or actual damage by pollution on the marine environment, develop and promote contingency plans against pollution, and actively participate in exchanges of information and data.

This year’s International Conference on the Law of the Sea will bring together experts from home and abroad, and they will share their experiences and the progress made in their research under the theme of "Regional Cooperation and Marine Environment Protection under UNCLOS”. The conference will serve as a venue for the participants to tap into their collective wisdom to explore ways to effectively apply UNCLOS articles on regional cooperation and protection of the marine environment.

On the first day of the conference, there will be presentations and debates about the cooperation obligations stipulated in UNCLOS and regional cooperation for marine environment protection. On the second day, participants will have in-depth discussions on marine scientific research cooperation in overlapping waters, regulation and prevention of marine pollution, and peaceful resolution of marine environment disputes.

This year, Jin-Hyun Paik, judge of the International Tribunal for the Law of the Sea (ITLOS), will give the keynote speech and Vice-President of ITLOS Tomas Heidar will participate as a presenter. Other ITLOS judges including Markiyan Kulyk, Oscar Cabello Sarubbi, and Neeru Chadha will also participate as presenters and debaters. Renowned international law scholars and practitioners in and out of the country will also take part in the discussions to seek ways to encourage regional cooperation in protecting the sea and its resources.
